Privacy & Terms Of Use

General

The Booly browser extension software ("add-on") is a service of Booly limited ("Booly") and is provided for personal, non-commercial use only. These terms are a legally binding agreement for the use of the add-on. You should read these terms carefully before you install or use the add-on. By downloading, installing the add-on or registering as a registered user, you accept these terms and conditions. If you do not accept these terms and conditions, do not install the add-on or if you have installed it remove it immediately.

Ownership / Intellectual Property

Booly is the exclusive owner of all copyrights, in particular usage, processing and utilization rights to the source and binary code of the add-on, its documentation and any other related subject capable of being (legally) protected. Apart from the rights, granted by this license, no more rights to the add-on will be granted.

All copyrights, trademarks, industrial designs, patents and other intellectual property rights (registered and unregistered) in reference to the add-on, including -and without limitation- the name "Booly" remain in the possession of Booly. You may use the add-on and all obtained information solely for your personal, non-commercial use and you must not copy, reproduce, publish or use the add-on and any obtained information otherwise for any other purpose. You also agree not to adapt or alter the add-on and not to create any derivative works. Any other use of the add-on or the gathered information requires the prior written consent of Booly.

The names, images and logos identifying Booly or third parties and their products and services are protected by copyright and trademark of Booly and / or third parties. Nothing in these terms and conditions will be interpreted as conferring any license or rights to use any trademark, registered designs or copyrights of Booly or any other third party.

What information do we collect?

We may collect, store and use the following kinds of information:

  • Anonymous technical data such as browser type, referral source, length of visit;
  • Information related to links clicked within the booly popup;
  • Information relating to the url that a user has clicked from within a booly popup;
  • Information relating to the url that a booly popup is shown on;
  • Information that you send as a message on the website, or post on a website comments board; and any other information that you choose to send to us.

The Booly add-on is only active on sites on which it can show a notification, or any url you choose to shorten. On all other sites it is inactive and no information is sent to Booly's servers when on those sites.

Right to be forgotten

If you wish to have your website account removed please email help(at)boo.ly with your email address and we will erase it. If you are using the browser addon then removing the addon is all that is needed.

Right to Access

To obtain a copy of the data we hold please email help(at)boo.ly with your email address and we will action your request within the required 30 days.

Cookies

We use cookies on this website. A cookie is a small text file sent by a web server to a web browser, and stored by the browser. The text file can then be read by the server when the browser requests a web page. This enables the web server to identify a browsing session.

We do not use cookies to track your use of the Internet in any other way or to store any personally-identifiable information, and we do not disclose cookie information to third parties (other than as required by legal process). (For example, in Internet Explorer you can refuse all cookies by clicking "Tools", "Internet Options", "Privacy", and selecting "Block all cookies" using the sliding selector.). Using your personal information

Personal information submitted on this website will be used for the purposes specified in this Privacy Policy or in relevant parts of the website. We may use your personal information to:

  • Improve your browsing experience by optimising the performance of the add-on or website
  • Send you email updates which you have specifically requested, directly from our email server
  • Provide third parties with anonymous statistical information about our users (but this information will not be used to identify any individual user);
  • Deal with enquiries and complaints made by or about you relating to the website;
  • Investigate the misuse or alleged misuse of the website;

We will not without your express consent provide information collected by the add-on or website to any third parties for the purpose of direct marketing.

Other disclosures

In addition to the disclosures reasonably necessary for the purposes identified elsewhere in this Privacy Policy, we may disclose information collected by the add-on:

  • To the extent that we are required to do so by law;
  • In connection with any legal proceedings or prospective legal proceedings
  • In order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk); and
  • Io the purchaser (or prospective purchaser) of any business or asset which we are (or are contemplating) selling.

International data transfers

Information that we collect may be stored and processed in and transferred between any of the countries in which we operate or in which our servers are situated in order to enable us to use the information in accordance with this Privacy Policy. Information which is generally available on the site (e.g. in the public parts of your profile) may be accessed by other users in countries which do not have data protection laws equivalent to those in force in the European Economic Area. You expressly agree to such transfers.

Security of your personal information

We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.

We will store all the personal information you provide in our password-protected database. Passwords will be stored in encrypted form. Our servers are protected by a firewall. In addition, all pages on the website relating to your personal information will be protected using SSL technology, and account details will be stored in our database in an encrypted form.

Of course, data transmission over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

You are responsible for keeping your password and user details confidential. We will not ask you for your password (except when you log into the website).

Policy amendments

We may update this Privacy Policy from time-to-time by posting a new version on our website. You should check this page occasionally to ensure you are happy with any changes.

Intellectual Property

All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and to the add-on including without limitation the name Booly are and shall be owned by Booly Limited. You may only use the add-on and information retrieved by it for you for your own personal, non-commercial use and you may not copy, reproduce, republish, or otherwise use the add-on or any information retrieved by it for you for any other purpose. You also agree not to adapt, alter or create a derivative work from the Booly Browser add-on or any information retrieved by it except for your own personal, non-commercial use. Any other use of Booly Browser add-on or any information retrieved by it requires the prior written permission of Booly Limited.

Third party websites

The website contains links to other websites. We are not responsible for the privacy policies or practices of third party websites.

Your rights

  • You may instruct us to provide you with any personal information we hold about you. Provision of such information may be subject to the payment of a fee (currently fixed at �10.00).
  • You may instruct us not to process your personal information for marketing purposes at any time by using our website contact form.

Disclaimer

  • The add-on and information retrieved by it including any information regarding or relating to third party products and services, is provided "AS IS" and on an "AS AVAILABLE" basis. To the extent permitted by law, Booly Limited excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy of the add-on or any information retrieved by it.
  • The add-on and information retrieved by it including any information regarding or relating to third party products and services, is provided "AS IS" and on an "AS AVAILABLE" basis. To the extent permitted by law, Booly Limited excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy of the add-on or any information retrieved by it.
  • Booly Limited shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the add-on regardless of the form of action.
  • Booly Limited do not warrant that the add-on will be uninterrupted or error free, that defects will be corrected, or free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
